We kindly request that you take the time to carefully read through these Terms of Use before using the website, application, and any services that we operate. Please note that we reserve the right to modify these rules at any time, with or without prior notice.

By using any of our services, you agree to our Terms, Privacy Policy, Community Guidelines, and Third Party Guidelines.

Intellectual Property and Disclaimer of Affiliation (Ownership Statement)

"Club Penguin Atake" is an independent, fan-operated online game and is not affiliated with, endorsed by, or sponsored by The Walt Disney Company or any of its subsidiaries or affiliates.

The "Club Penguin" name, characters, artwork, and other related intellectual property are the sole and exclusive property of The Walt Disney Company. We do not claim any ownership of this intellectual property. We are using this intellectual property for non- commercial, recreational purposes only.

By using our services, you acknowledge and agree that you are participating in an unofficial, fan-made project. You agree not to hold "Club Penguin Atake" or its staff liable for any issues that may arise from your use of this service, including any claims related to intellectual property infringement. You also agree to not hold The Walt Disney Company or its staff liable for any issues that may arise from your use of this service.


Accounts and Profiles

The game service itself requires an active account, which can be created with us only if the user is old enough.

Our Account system (One Live ID – Club Penguin Atake) will automatically prompt you to provide your birthdate upon your initial login, or since the revision of this document. This section is referred to as the “age gate.”

If a user is under the specified age, all account information will be promptly deleted. For users who are over the required age, we store the birthdate alongside your account details.

Minimum age requirements:

If the user is under the required age, they are forbidden from accessing the Site and any associated services.

Club Penguin Atake may release information about you (including your Data) if we believe it is necessary to resolve a complaint about your use of the Site or to contact someone who may be infringing on Club Penguin Atake's or visitors' rights or property. We do not release user information to third parties without their authorisation.

A Club Penguin Atake Account needs to be activated within 7 days of creation to continue using the service. Accounts that were not activated in time will be disabled. We only support the following email providers:

Any attempt to share, transfer, auction, or sell the account is void, and such attempts, whether made by the account holder or not, will result in the account's immediate termination.
If you fail to comply with these terms of service or any additional rules relating to a specific service, or for any other reason, we can terminate your account and your ability to use the Site.

Users acknowledge that they are responsible for all activities that occur related to their account. Club Penguin Atake, or its staff members will not be held liable for any mistakes or damages that occur as a direct result of actions made with your account.


Virtual Goods and Currency

Our services may include virtual goods, such as in-game items, and virtual currency ("Virtual Goods"). These Virtual Goods are not real-world currency and have no monetary value. You do not own the Virtual Goods you obtain. You are granted a limited, non-transferable, revocable license to use the Virtual Goods for your personal, non-commercial entertainment purposes within the game.

We have the right to manage, regulate, control, modify, and/or eliminate Virtual Goods at any time, with or without notice. We shall have no liability to you or any third party if we exercise any such rights.


Notice and Action Procedures

Reporting Illegal Content

In compliance with Article 16 of the EU's Digital Services Act, you have the right to report content that you believe is illegal in the European Union.

How to report:

  1. Clear explanation of why you believe the content is illegal under EU law
  2. Location with date and time of the content
  3. Contact information (full name, email address)
  4. Statement confirming good-faith belief in accuracy of your report

How we respond and process complaints:

  1. We acknowledge the report within 7 days
  2. All reports are assessed within 7 days of receipt
  3. Decision timeline:
    1. All content moderation decisions: Completed within 7 days
    2. Complex cases requiring external consultation: May take up to 14 days
For any change or update regarding your report, you will be notified by email.

Prioritisation:

We prioritise reports in the following order:

  1. Content involving minors’ safety
  2. Content promoting violence or terrorism
  3. Hate speech and harassment
  4. Other EU law illegal content

Reporting content against Club Penguin Atake Policies and Guidelines

To keep our services safe and welcome for everyone, users can report other users for violating our policies and guidelines.

How to report:

Required information for report:

  1. You need to be logged into your Club Penguin Atake Account
  2. The reason for your report
  3. Username or display name of the offender
  4. Description of the violation
  5. (optional) URL to proof of the offender committing a violation
  6. How this violation affected your gameplay / experience

How we respond and process reports:

  1. We acknowledge the report within 7 days
  2. Moderators analyse your report along with provided evidence and internal logs
  3. Decision timeline:
    1. Violating content removed immediately after moderator investigation
    2. Lighter violations: a warning is issued to the offender. Warnings expire after 30 days.
    3. Repeated or more important violations: offender’s account is temporarily or permanently banned from the platform.
  4. If we find your report helpful, you might receive an email from Club Penguin Atake Support informing you about the report’s results. Please note, you might not always receive an email: for example, if your report was deemed unhelpful or false.

Appeals and Internal Complaint-Handling System

If you disagree with our content moderation decision, you have the right to request an internal review through our appeals process.

How to appeal:

  1. A violation issued no more than 7 days before your appeal date
  2. The reason for your appeal
  3. Detailed explanation of why you believe the decision was incorrect
  4. (optionally) Supporting evidence

Our Appeals Process:

  1. Appeals acknowledged within 7 days
  2. Appeals decided within 7 days of issuing date
  3. Appeals are reviewed by different staff members than those who made the original decision
  4. You will receive a notice via email about the final decision and notes regarding it

General Information About All Reports and Appeals

For reports involving immediate threats to safety, minor protection, or other urgent matters, we will act as quickly as possible, potentially within hours of discovery.

Our 7-day timeline excludes major holidays.


Content Moderation and Our Commitment to Transparency

In accordance with Article 17 of the EU's Digital Services Act, if we take any such action, we will provide the affected user with a clear and specific explanation (a "statement of reasons") for our decision. This will include:

  1. The reason for the restriction (e.g., which guideline of the Community Guidelines was violated).
  2. The content that was in violation.
  3. Information on how to appeal the decision.

We will not provide this information if we are legally prohibited from doing so by an official authority or if providing it would obstruct a legal investigation.

Transparency Reporting

In compliance with Article 15 of the Digital Services Act, we publish annual transparency reports detailing our content moderation activities. These reports include:

Algorithmic System Transparency

Automated Decision-Making and Algorithmic Systems

  1. Content Moderation Systems:
    1. Chat Filter: Automated message filtering to filter out toxicity, links, illegal content
    2. Account Access Restriction: If user sends an inappropriate message, our chat filter automatically issues a warning. If this action is repeated for 3 times, our system automatically bans the offender for 24 hours.
  2. Human Oversight:
    1. Users can request human review of any automated or manual access restriction
    2. Our staff regularly audit and update automated systems for accuracy
  3. Transparency:
    1. Automated systems are designed to help our moderators do their work more easily
    2. Users are notified when a moderator or an automatic system has taken action on their content
    3. We provide clear information about how to appeal decisions


Protection of Minors in the European Union

Club Penguin Atake is committed to providing a high level of privacy, safety, and security for our users, especially minors. In compliance with the EU's Digital Services Act, we have implemented measures to protect users under the age of 18.

We moderate our chats regularly with real moderators. All messages go through a filter that stops harmful and malicious messages from sending. Users that send such messages get three violations per sessions. After the third one, the user is banned for 24 hours.

We design our experiences to collect the minimum amount of personal data possible and to prevent exposure to harmful or inappropriate content.

Our websites may include features (such as blogs and chat rooms) that allow users to publish and share comments and/or content.

Users conduct not to publish or share messages or content of any kind in such areas that violate on any party's rights, or break any relevant laws, using any type of submission.
Users agree that any conversations or anything they submit in the areas are non-confidential for any reason.

Members who use the chat or submission features are solely responsible for their communications and any consequences that follow from them.
We are not obligated to post, deliver, remove, edit, or otherwise utilise or act on messages you send through the areas, and we reserve the right to refuse to do so.

Club Penguin Atake, its staff, contributors, and suppliers are not liable for any direct, indirect, incidental, special, or consequential damages, loss of profits, or injuries resulting from the use of the areas or dependence on the information and/or content posted in the areas, whether in fact or law.


Dispute Resolution

Informal Resolution Requirement

Both parties—the user and Club Penguin Atake—are required to make a genuine effort to resolve the issue informally. This involves direct communication between the service operator and the disputing party to discuss the concerns and attempt to reach a mutually acceptable solution. The informal resolution process should be initiated within 30 days of the issue arising. Both parties are expected to engage in good faith discussions, aiming to resolve the matter within 15 business days from the start of the informal resolution effort.

Mediation in Case of Failed Informal Resolution

If the informal resolution process does not result in an agreement, either party may seek the assistance of a neutral third-party mediator. Both parties must agree on the choice of the mediator, and all mediation sessions will be conducted in good faith to facilitate a fair resolution. If informal resolution fails, mediation should be initiated within 30 days of the conclusion of the informal resolution efforts. The mediation process should aim to reach a resolution within 60 days from the date the mediator is appointed.

Waiver of Arbitration and Class Action Rights

By agreeing to these Terms of Use:

  1. Both the users and Club Penguin Atake expressly waive their rights to arbitrate any disputes.
  2. Users waive their rights to file a lawsuit in court, whether individually or as part of a class action lawsuit, except for matters that fall within the jurisdiction of small claims courts, unless otherwise required under the GDPR.
  3. These waivers apply to all claims arising out of or related to the use of Club Penguin Atake's services or related services.

Final Note

These are the only recognized methods for dispute resolution within the scope of Club Penguin Atake. Users agree to adhere to these procedures.


Digital Millennium Copyright Act (DMCA) Takedown Procedure

Club Penguin Atake respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond expeditiously to claims of copyright infringement committed using the Club Penguin Atake service that are reported to our Designated Copyright Agent, identified in the sample notice below.

If you are a copyright owner or authorised to act on behalf of one, please report any alleged copyright infringements occurring on or through our site by completing the DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, we will take appropriate action, in our sole discretion, including removing the challenged material from the site.

Responsibility and Limitations

Users are responsible for any criminal and civil penalties issued by law enforcement agencies in connection with their account, subject to applicable laws in their jurisdiction.

Members agree to release Club Penguin Atake's vendors, staff members, representatives, volunteers, and affiliates from civil liability caused by third-party negotiations, claims, actions, or disputes relating to your Content or Data, your use of the Site or Applications, or any wilful misconduct on your part.

We have the right to terminate a member's use of any service based on the data they submit.

The content hosted on our servers is regularly backed up. In the event that our server is shut down, we will restore any lost data to reduce the impact and downtime for users.

To the fullest extent permitted by law, none of the Site's affiliates, operators, or volunteers will be liable to any person(s) for indirect, incidental, special, punitive, cover, or consequential damages caused, under any theory of liability, including, but not limited to, contract, tort, warranty, breach of mandatory duty, negligence, or otherwise, even if we were advised of the possibility of such damages or could have foreseen them. These limitations apply even if this solution does not compensate you for any losses or fails to meet its primary objective. Termination

You may terminate these terms of service at any time by discontinuing use of the Site and erasing any contents obtained from it, as well as any related documents, copies, and installations, whether made under these terms of service or not.

Club Penguin Atake reserves the right for our operators and staff members to terminate your account without warning.

We have the right, at all times, to terminate these terms of use with respect to you, including your access to the Site, including, but not limited to, if you violate or fail to comply with any essential term or condition of these terms of use. You must discontinue using the Site after it has been terminated.

Notifications about Policy updates

For any substantial changes (defined as alterations that impact our operations, restrict access to specific users, or introduce significant modifications to existing policies) we will notify users through app announcements and provide a 30-day grace period before the updated policy takes effect.

For minor modifications, we will inform users via app announcements and establish a 24-hour period before the updated policy becomes applicable.

This section applies to all Club Penguin Atake Policies, including but not limited to: Terms of Use, Privacy Policy, Third-Party Guidelines, Community Guidelines, Labs Terms of Use, and Public Quality Assurance Terms of Use.


Miscellaneous

If we make major modifications to these service-specific terms, we will notify you and allow you to review them.

To end your relationship with Club Penguin Atake, see our Privacy Policy and learn how to close your account. If our online moderators find a violation of these terms, we keep the right to terminate these conditions in relation to you. These terms only apply to your connection with Club Penguin Atake, not to any other organisations or individuals, even if they legally benefit from it.
